Tshwane CCTV provider ‘not corrupt’

Tshwane CCTV service provider Morubisi Technologies was not involved in any tender rigging, and was awarded the multimillion rand contract on merit. Nor was the company blacklisted by the North West provincial legislature as claimed, Morubisi founder and chairman Fana Moraka said on Monday. Moraka’s comments followed a report in the Pretoria News on Monday giving details of how tender processes in Tshwane unfolded before Morubisi emerged as the victorious bidder. A second bid evaluation committee had to be constituted by the office of the city manager after its predecessor awarded the tender to another company without following due process.

The Pretoria News learnt during the two-week investigation that both committees were accusing each other of manipulating the tender process in favour of what was perceived to be their preferred bidder. Following the report, it emerged that the North West legislature had terminated a similar five-year contract with Morubisi entered into in 2008 on the grounds of the poor installation of the system. But Moraka said the company challenged the North West termination in court. However, the legal process was not pursued further because the contract had by then lapsed. Instead, Morubisi entered into a settlement agreement with the provincial government for the contract to be dissolved mutually. As part of the agreement - dated June 2, 2015 - the parties agreed there was no legal action to be taken against each other.

The termination letter which has now found its way to Tshwane had been used before to block Morubisi from being awarded a CCTV tender by the West Rand District Municipality, Moraka claimed. West Rand had written to the North West government requesting clarity on the matter to “avoid an embarrassment of appointing a service provider that has previously dismally failed in its contractual obligation. We successfully took the matter to court and the municipality was ordered to advertise the tender again”, he said. The Pretoria News has seen copies of the termination letter from North West, the settlement agreement and communication with the West Rand municipality. Moraka blamed a former senior official at his company for wanting to use the past against Morubisi, saying the same tactic unsuccessfully played itself out in the West Rand. The official was now also involved in the same type of business and had used Morubisi’s contacts for his gain, said Moraka.
