Eskom hands over documents to Westinghouse

Eskom on Monday rejected claims that it had not handed over documents to the losing bidder for a tender to replace generators at the Koeberg nuclear power station. “Westinghouse has made repeated assertions that Eskom refuses to provide it with documents relating to the Koeberg steam generator replacement matter,” Eskom said in a statement. The parastatal said it had fully complied with the High Court in Johannesburg's order that it hand over the documents relating to the awarding of the R4 billion tender. Westinghouse Electric Company had initially wanted to get an interdict to stop Eskom from either signing a contract with Areva NP Proprietary, or implementing the contract if it had already signed it.

It wanted Eskom to provide documents detailing why Areva had been awarded the tender. Eskom has said the tender was awarded by its board tender committee on August 12, and that both Areva and Westinghouse were notified of the decision. Westinghouse previously complained that Eskom had not disclosed all the necessary documents. Eskom said a process was under way to determine the confidentiality and/or commercial sensitivity of some of the requested information. “Eskom remains confident that the courts will confirm that Eskom has acted within the prescribed procedures throughout the process.”
